About ETF View

ETF View is an independent industry forum convened by Ultumus Ltd ("Ultumus", "we", "us" or "our"), a company incorporated in England and Wales (registered number 10428499), whose registered office is at 4th Floor, 33 St. Mary Axe, London, EC3A 8AA. The website is located at www.etfview.com (the "Website").

ETF View brings together participants in the ETF ecosystem – including authorised participants, market makers, transfer agents, securities services providers, asset managers and ETF issuers – to share operational insights, collaborate on best practices, and collectively address emerging challenges in ETF infrastructure and operations.

ETF View is not a commercial or vendor platform. Whilst convened by Ultumus, the forum operates independently and all participants have equal voice regardless of any commercial relationship with Ultumus.

 

Acceptance of Terms

By accessing the Website, registering as a member, or participating in ETF View activities (including meetings, working groups, and communications), you agree to be bound by these Terms and Conditions in full. If you do not accept these Terms and Conditions, you must cease using the Website and may not participate in ETF View activities. 

These Terms and Conditions should be read in conjunction with our Privacy Policy, which sets out how we collect, use and protect your personal data. In the event of any conflict between these Terms and Conditions and our Privacy Policy, these Terms and Conditions shall prevail except in relation to data protection matters. Ultumus grants you a limited, non-exclusive, non-transferable right to access and use the Website and participate in ETF View activities solely for lawful, professional and non-commercial collaborative purposes and subject to these Terms.

 

Registration and Membership

Access to certain areas of the Website and participation in ETF View activities requires registration. By registering, you confirm that:

(a)  you are a professional participant in the ETF ecosystem and are registering in a business capacity;
(b)  all information you provide during registration is accurate, complete and up to date;
(c)  you will notify us promptly of any changes to your registration information;
(d)  you will keep your login credentials confidential and take responsibility for all activity carried out under your account.

Ultumus reserves the right to accept or decline any registration at its discretion and to withdraw membership access at any time if, in its reasonable opinion, these Terms and Conditions have been or may be breached, including where necessary to protect the integrity, neutrality or regulatory compliance of the forum.

 

Information Exchange and the Chatham House Rule

ETF View is intended to facilitate general industry dialogue and does not constitute any form of coordination, agreement or concerted practice between participants.

Participants must not use ETF View to exchange competitively sensitive information (including pricing, trading strategies, client data or commercially confidential information) where such exchange would breach applicable competition or antitrust laws.

ETF View meetings and communications operate under the Chatham House Rule unless otherwise stated. Under this Rule, participants are free to use the information they receive at meetings and in communications, but may not attribute it to any specific speaker or organisation, or otherwise identify the source.

By participating in ETF View activities, you agree to:

(a)  respect the Chatham House Rule and not disclose the identity of any other participant in connection with the content of discussions;
(b)  use information exchanged within the forum only for the purposes of understanding and addressing shared operational challenges in the ETF ecosystem;
(c)  not use information exchanged in the forum for commercial advantage in a manner that is contrary to the spirit of open industry collaboration;
(d)  treat commercially sensitive information shared by other participants with appropriate discretion.

Ultumus reserves the right to remove any participant from the forum who, in its reasonable opinion, has breached these obligations.

 

User Conduct

When using the Website and participating in ETF View activities, you agree not to:

(a)  post, transmit or share any content that is unlawful, defamatory, misleading, confidential (in breach of any duty of confidence owed to a third party), or otherwise inappropriate;
(b)  use the Website or forum for any commercial solicitation, marketing or promotional activity without the prior written consent of Ultumus;
(c)  attempt to gain unauthorised access to any part of the Website or to any user accounts, systems or networks connected to it;
(d)  use any automated means (including robots, scrapers or crawlers) to access or index the Website;
(e)  transmit any malicious software, code or content that could damage, disrupt or interfere with the Website or any user's equipment;
(f)  impersonate any person or entity or falsely represent your affiliation with any person or entity.

You must at all times comply with applicable competition laws and regulatory obligations when participating in ETF View activities.

Ultumus may suspend or restrict access to the Website or participation in ETF View at any time where it reasonably considers there has been a breach of these Terms or a risk to the integrity or lawful operation of the forum.

 

Content, Papers and Discussion Materials

Ultumus may from time to time publish papers, reports, discussion documents and other materials on the Website or distribute them to ETF View members ("Forum Materials"). Forum Materials are provided for the purposes of facilitating industry discussion only. Forum Materials and Member Content and do not constitute investment, regulatory, legal or other professional advice and should not be relied upon for investment, trading or commercial decision-making purposes.

Ultumus makes no warranty, express or implied, as to the accuracy, completeness or currency of Forum Materials. Ultumus shall not be liable to the extent permitted by law for any loss or damage arising from reliance on Forum Materials. 

Members and participants may contribute content to the forum ("Member Content"). By contributing Member Content, you grant Ultumus a non-exclusive, royalty-free licence to use, reproduce and distribute that content within the ETF View forum and on the Website. You represent and warrant that you have the right to grant this licence and that the Member Content does not infringe the rights of any third party.

 

Data Capture and Privacy

When you register for ETF View, respond to forms, attend meetings or otherwise interact with the Website, Ultumus will collect and process personal data about you. This may include your name, job title, organisation, contact details and records of your participation and engagement with the forum.

Ultumus uses this data to:

(a)  manage your membership and forum participation;
(b)  communicate with you about ETF View activities, meetings and publications;
(c)  understand engagement and improve the forum's programme and content;
(d)  comply with applicable legal and regulatory obligations.

Ultumus will not sell your personal data to third parties. We may share data with trusted technology and service providers (such as our CRM and event management platforms) who process it on our behalf, and who are contractually bound to protect it.

To the fullest extent permitted by applicable law, Ultumus excludes all liability for any direct, indirect, special, incidental, consequential or punitive loss or damage arising from: (a) your use of or inability to use the Website; (b) your participation in ETF View activities; (c) reliance on any information, Forum Materials or Member Content; or (d) the conduct of other participants in the forum.

Nothing in these Terms and Conditions limits or excludes Ultumus's liability for fraud, fraudulent misrepresentation, death or personal injury caused by its negligence, or any other liability that cannot be excluded or limited by law.

Ultumus does not accept responsibility for the conduct, statements or omissions of other participants in ETF View.

 

Amendments

Ultumus reserves the right to amend these Terms and Conditions at any time. Any amendments will be posted on this page with an updated date and, where material, Ultumus will use reasonable efforts to notify registered members by email. Your continued use of the Website or participation in ETF View following any amendments constitutes acceptance of the revised Terms and Conditions.

 

Governing Law and Jurisdiction

These Terms and Conditions and any dispute or claim arising out of or in connection with them (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of England and Wales.

The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions.
